Car Theft Insurance Coverage and Reporting Steps

Car theft may be covered under the theft protection included in own-damage coverage. There is a 30-day waiting period after filing a police report before claiming insurance benefits, while deregistration and re-registration after recovery must be handled separately.

Vehicle theft may be covered if you have theft coverage under Own Vehicle Damage coverage. After reporting it to the police, notify your insurer immediately. You may claim theft insurance benefits only after 30 days have passed since the police report.

What insurance covers vehicle theft?

Theft loss involving your vehicle should be checked under Own Vehicle Damage coverage. Compulsory liability insurance alone does not compensate you for the value of your stolen vehicle. First, check your insurance policy to confirm whether you have Own Vehicle Damage coverage. Review the terms and conditions of the relevant contract for the scope of theft coverage.

Own Vehicle Damage coverage covers damage to the insured vehicle itself. Cash or bags left inside the vehicle are treated separately from the vehicle. Installed accessories are subject to different policy terms from personal belongings.

How to report a missing vehicle

If you suspect theft, report it to the police first. Also check whether the vehicle was towed or used by a family member. If there are clear signs of theft, do not delay reporting it while making these checks.

  1. Report it to the police. An urgent theft report can be made by calling 112. Provide the vehicle registration number and its last parking location.
  2. Prepare documents confirming the incident. Ask the police about the process for obtaining a theft report confirmation or similar documents. These documents are used to claim insurance benefits and cancel the vehicle’s registration.
  3. Report the incident to your insurer immediately. Provide the police report number and the circumstances of the theft. Accurately explain how the vehicle keys were stored as well.
  4. Organize the evidence. Record the last time you confirmed that the vehicle was present. Keep the originals of parking records or any video footage you have obtained.

Notification to the insurer is not a procedure that should wait 30 days. Article 657 of the Commercial Act requires notification without delay after becoming aware of an incident. Any loss increased by delayed notification may be excluded from coverage.

What documents are required for an insurance claim?

A theft insurance claim requires evidence of both the incident and the loss. Additional documents vary depending on whether the vehicle has been recovered. Ask the claims representative for a case-specific submission list and prepare the documents accordingly.

A total loss is a method of settling a claim by compensating for the loss of the entire vehicle. A certificate of cancellation of registration is required for a theft total-loss claim. Scrapping documents apply when the vehicle was actually scrapped. They are not required as a standard submission for every theft claim.

The claim details vary depending on when the vehicle is recovered and whether it is damaged. Recovering the vehicle within 30 days does not mean that every loss disappears. Damage to the vehicle may be reviewed for compensation under the applicable coverage.

When and how much will theft insurance pay?

The 30 days after the police report are the waiting period before a theft insurance claim may be filed. This does not mean that payment is automatically deposited on the 30th day. After the claim is filed, the incident must be investigated and the payment amount determined.

The insured amount is not necessarily the actual amount paid. The standard terms set the insured amount as the compensation limit. If the insured amount exceeds the insurance value, the insurance value becomes the limit. Check each insurer’s terms and conditions for the specific calculation method.

Before filing a claim, request the basis for calculating the following items.

Do not calculate the payment based only on the vehicle’s purchase price or the remaining installment balance. The insurance value is the vehicle’s value assessed under the terms and conditions. Obtain the calculation details and compare them with your contract.

How do you cancel the registration of a stolen vehicle?

Cancellation of registration due to theft is a separate procedure that must be filed with the vehicle registration authority. A police report alone does not cancel a vehicle’s registration. The Easy Law Information Service advises applying within 1 month from the date of theft.

  1. Contact a registration authority, such as a vehicle registration office. Explain that you intend to cancel the registration because of theft.
  2. Prepare the application and evidence of theft. Also explain if you cannot submit the registration certificate·license plates. Confirm the appropriate submission method for your circumstances.
  3. Check whether an agent may apply. If an agent files the application, additional documents such as a power of attorney are required.
  4. Obtain a certificate after cancellation is completed. Submit it to the insurer for the theft total-loss claim.

The Gwangjin-gu guidance on applying for cancellation of vehicle registration lists a theft report confirmation as a required document. Additional documents may be required if an interested party is listed in the vehicle register. Confirm the actual preparation list with the registration authority where you will file the application.

Each time period in the theft process has a different starting point. Assuming that the theft date and police report date are the same can make it easy to confuse the deadlines. Keep evidence for each date together in a single incident record.

You should continue preparing to cancel the registration during the 30-day waiting period. If you wait for the insurance payment before starting the cancellation procedure, the timelines may not align. If the exact time of theft is unknown, record it while stating that it is an estimate.

Can you drive a recovered vehicle immediately?

The registration of a vehicle that has already been canceled is not automatically restored upon recovery. A vehicle deregistered due to theft must undergo new registration within 3 months from the date of recovery. Handle it separately from a vehicle whose registration was not canceled.

  1. Notify the police and insurer that the vehicle has been recovered. Check which documents are needed to clear its stolen status.
  2. Check the vehicle’s registration status. If its registration has been canceled, ask the registration authority about new registration for reinstatement.
  3. Complete the permits and inspections required for operation. Check the procedures for a temporary operation permit and new-registration inspection.
  4. Use the vehicle only after checking its registration and insurance status. If insurance benefits were paid, first discuss the vehicle’s return·settlement with the insurer.

Can compulsory insurance be canceled after theft?

If the vehicle can no longer be operated due to theft, this may constitute grounds for cancellation under the terms and conditions. However, the insurance contract does not terminate automatically merely because a report was filed. An exception applies if the contract was transferred to a replacement vehicle.

Submit evidence of the theft to the insurer and confirm the applicable handling criteria. The cancellation date and refunded premium must be checked separately. Also inform the theft claims representative about the claim currently in progress.

Treating the report, claim, and registration as a single procedure can easily lead to omissions. Do not give up on a claim solely because the doors were not locked. Coverage also cannot be determined solely because the keys were left unattended. A review based on the circumstances of the incident and the applicable terms and conditions is required.

A false vehicle theft report may be punishable. Falsely accusing another person may constitute the offense of false accusation. Obtaining administrative action through false documents may constitute obstruction of official duties.

Claiming insurance benefits for a fabricated incident may also constitute insurance fraud. This includes claims that misrepresent the occurrence or details of an insured event. The definition is set out in Article 2 of the Special Act on the Prevention of Insurance Fraud.

Can I receive compensation for vehicle theft if I only have liability insurance?

Liability insurance does not cover damage from the theft of your own vehicle. You need to check whether you have theft coverage under Own Vehicle Damage coverage.

Should I contact the insurance company immediately after reporting it to the police?

You must also notify the insurance company of the incident without delay. The 30-day waiting period for theft insurance benefits does not mean that you may delay reporting the incident.

Will the insurance benefit be deposited on the 30th day after I report the theft?

Do all recovered stolen vehicles have to be newly registered?
