Will my last words to my family on my deathbed be recognized by the law? The short answer is that a simple verbal will is not legally valid. Our civil code recognizes only five types of wills: handwritten, recorded, equitable, secret, and oral. In particular, a recorded will is not valid simply because it is spoken: it must be witnessed, the testator's name, the date, and the content of the will must be clearly recorded. If any of these requirements are missing, the will is invalid. Most inheritance disputes start with a problem with the form of the will. Form is more important than substance. Preparing a legally compliant will in advance is the surest way to protect your family. #legal validity of oral wills #will validity #written wills #recorded wills #recorded will requirements #inheritance disputes #will form #civil law wills
